Case Conclusion Date: June 1, 2010

Practice Area: DUI / DWI

Outcome: Not Guilty on all criminal counts

Description: Client charged with driving under the influence of drugs, alcohol, and combined influence law. Successfully had drugs and combined influence charges dismissed on pre-trial motion. At trial, client found not guilty of driving while intoxicated (alcohol) as I was able to convince jury that client’s medical issues created reasonable doubt as to whether officers observed intoxication by alcohol.

Practice Area: Criminal Defense

Outcome: Dismissal

Description: I represented a young Iraq war veteran who was falsely accused of vehicular homicide. A “friend” of my client had used his car without permission and ran down a pedestrian in the Bronx. He left the scene of the accident and told my client the car had been damaged in the course of a parking lot brawl. My client was arrested driving his damaged vehicle home. Despite his protests, the police were convinced they had the right suspect and my client spent 6 days at Riker’s Island. Within days of being retained, I was able to secure the parking lot surveillance video which showed the other party driving off in my client’s car and then returning minutes later, with severe front-end damage. The evidence was enough to secure my client’s immediate release and the ultimate dismissal of the charges.

Practice Area: Criminal Defense

Outcome: Criminal case dismissed. Disposed of with a violation.

Description: Client was charged with a felony (burglary) and had another attorney represent her for two years. The attorney got her an offer, to plea to the felony, but kept adjourning it hoping the government would not require jail time. She came to my office asking for a better disposition since she did not feel comfortable with the attorney she had. Our firm took the case and in two months, I was able to get the case reduced to a violation (not a crime) with a small fine. Therefore, we were not only able to save her from jail time and avoid a felony conviction but also avoid a criminal convictioin altogether.

Practice Area: Criminal Defense

Outcome: Aquitted of all charges after trial.

Description: Client charged with Resisting Arrest, Obstructing Governmental Administration, and Felony Assault of a police officer. He fired his previous attorney and hired my office. He admitted that he resisted by biting a police officer causing a serious bite mark to the officer’s arm. The issue in the case was whether the police were within their authority to enter his home. With his previous attorney at a hearing, the judge decided that the police were within their legal authority to enter the home. However, at trial, the jury was asked to decide on the same question. Mr. Isley hired Raiser & Kenniff for the trial.
