Estate Planning

When we meet with a client, we will go over all of the documents necessary to effectuate their estate planning goals. This will include the review of their present Estate Plan and the possible recommendation for the preparation of a new Last Will and Testament, Power of Attorney, Revocable or Irrevocable Living Trust, and Health Care Proxy.

We counsel our clients in connection with the re-titling of assets that may help them avoid the Probate process, while making sure to conform to the client’s Estate Plan. Probate is needed when a person owns assets individually, without a joint-owner or named beneficiary listed on the account.

The attorneys at Raiser & Kenniff also will show their clients ways to save thousands of dollars in case the need arises that the client may need Nursing Care in the future. This Medicaid Planning is accomplished by the client setting up lifetime Trusts and making certain transfers of assets.

Estate Administration

After a loved one dies, our Trusts and Estate attorneys are there to help the family during a very emotional and difficult time. We represent both Executors (someone named in a Will) and Administrators (someone appointed when a person dies intestate or without a Will) in the Surrogate Court in administering the Estate of a decedent. The administration of an Estate encompasses the collection of all the assets of a Decedent, the payment of all legally enforceable debts, the payment of any estate tax that may be due, and the transfer of any property that is left over to the named beneficiaries under the Will or to those entitled to the property under New York Laws of intestacy. Our attorneys handle the entire process of administration with care, sensitivity, and expertise.

Real Estate

Our Trust and Estates attorneys represent clients in the sale, purchase, lease, and refinance of residential and commercial real property. This representation includes preparing and reviewing contracts of sale, ordering or reviewing title reports to the property, correcting any defects in titles, reviewing mortgage commitments clients gets from their lenders, and representing clients at closings.
